Terms of Service

1. Agreement

These Terms of Service (“Terms”) are an agreement between you and BHSTUDIO LLC (“BHSTUDIO,” “we,” “us,” or “our”). By accessing or using a service that links to these Terms, you agree to them and to our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and authority

You must be legally able to enter into this agreement. If you use a service for an organization, you represent that you have authority to bind that organization. Children may use a service only when permitted by the product, platform rules, and applicable law, with any required parent or guardian authorization.

3. License to use our services

Subject to these Terms, BHSTUDIO grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the service for its intended purpose. You may not copy, resell, sublicense, reverse engineer, bypass access controls, or exploit a service except where applicable law expressly permits it.

4. Accounts and security

Some products may offer or require an account. You are responsible for accurate information, for maintaining the confidentiality of your credentials, and for activity under your account. Notify us promptly if you believe an account or device has been compromised.

5. Your content

You retain ownership of content you submit. You grant BHSTUDIO and its service providers a limited license to host, transmit, reproduce, and process that content only as needed to operate, secure, support, and improve the requested service, subject to our Privacy Policy.

You represent that you have the rights and permissions needed to submit the content and that it does not violate law or the rights of another person.

6. AI and automated outputs

Some services use artificial intelligence, machine translation, automated analysis, or other probabilistic systems. Outputs may be incomplete, inaccurate, outdated, or unsuitable for your situation. You must review outputs before relying on or publishing them. Do not use automated output as a substitute for qualified medical, legal, financial, safety, or other professional advice.

7. Acceptable use

You may not use our services to:

• violate law, intellectual-property rights, privacy rights, or platform rules;
• harm, threaten, harass, defraud, impersonate, exploit, or mislead others;
• distribute malware, attempt unauthorized access, probe vulnerabilities, or disrupt a service;
• bypass limits, automate abusive traffic, manipulate advertising, or interfere with security controls;
• submit unlawful content or use a service to create or facilitate illegal activity.

8. Advertising and third-party services

Some products display advertising or integrate third-party platforms, content, APIs, stores, or websites. Third-party services are governed by their own terms and policies. BHSTUDIO does not control and is not responsible for third-party services, availability, content, or transactions.

9. Purchases and subscriptions

If a product offers paid features, prices, billing periods, renewal terms, cancellation options, and refund rules will be shown at purchase. Purchases made through Apple, Google, or another marketplace are also governed by that marketplace’s billing and refund terms.

For applications licensed through Apple’s App Store, Apple’s Standard Licensed Application End User License Agreement applies unless the product presents a valid custom license agreement.

10. Intellectual property

The services, software, design, branding, documentation, and related intellectual property—excluding your content and third-party materials—are owned by BHSTUDIO or its licensors. No rights are granted except the limited license stated in these Terms.

11. Changes and availability

We may add, modify, suspend, limit, or discontinue features, and we may release updates required for security or compatibility. We do not guarantee that every service or feature will always be available, error-free, or compatible with every device or region.

12. Suspension and termination

We may suspend or terminate access when reasonably necessary to protect users or the service, comply with law, address nonpayment, or respond to a material violation of these Terms. You may stop using a service at any time and may use available account or product controls to delete data where offered.

13. Disclaimers

To the maximum extent permitted by law, services are provided “as is” and “as available.” BHSTUDIO disclaims implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

14. Limitation of liability

To the maximum extent permitted by law, BHSTUDIO and its members, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from a service. Our aggregate liability for a claim will not exceed the greater of the amount you paid us for the relevant service during the twelve months before the claim or USD $100. These limits do not apply where prohibited by law.

15. Indemnity

To the extent permitted by law, you agree to defend and indemnify BHSTUDIO from third-party claims arising from your unlawful use of a service, your content, or your material violation of these Terms. This section does not apply where prohibited by applicable consumer law.

16. Governing law

These Terms are governed by the laws of the State of Montana, United States, without regard to conflict-of-law principles. Courts located in Montana will have jurisdiction, except where mandatory consumer law gives you the right to bring a claim elsewhere.

17. Changes to these Terms

We may update these Terms to reflect changes in our services or legal obligations. The effective date above shows the latest revision. Continued use after updated Terms take effect means you accept them, to the extent permitted by law.
